Late Fee

My tenant is not paying her rent on time.  Are there any laws staing you can charge late fees on rent in Massachusetts?  If so what is the percentage?

If the rent is due on the first then you should be getting two late fees one for April and one for May.   And it is doubtful she would be caught up by June so she will also owe for June.   The payment should go to the oldest debt first so when she pays in May that money gets credited for Aprils rent.  Unless you have judgement for back rent then credit the payment to the current month and leave the judgement in-tacked until they pay everything.
You cannot "skip" a month's overdue rent (pay May but not April). Any money paid should be applied to the first missed months rent. That'll keep things simple.
If she only pays May rent and not April, still charge her for the late fee until she pays the April rent
You apply the rent as it is owed--April first then May--The tenant doesnt dictate the method of how money recieved is applied. Also check the local law regarding the COVID tenant protection law.
