Illinois Landlords must provide Tenants with a Radon Hazards Disclosure statement before entering into a Lease Agreement.



Illinois Tenant Radon Protection Act


As of January 1, 2024, the Illinois Tenant Radon Protection Act requires that Landlords provide Tenants with: 

  1. A Radon Hazards Disclosure statement; and 
  2. A copy of the current Radon Guide for Tenantscreated by the state of Illinois. 

The Act also states that Tenants have a right to conduct a radon test. If tests are done, the Tenant must provide the Landlord with results within 10 days of testing. The Landlord can verify with additional testing. If elevated levels of radon are found, the Landlord has 60 days to choose whether or not to mitigate. If the elevated levels are not mitigated, the Tenant can terminate the tenancy without penalty. 

All Illinois Landlords should attach the Radon Hazards Disclosure as an addendum to their Illinois Lease Agreement.
