Hold over tenant

Tenant is a hodover any defense

The only thing you can do is file for eviction, unfortunately.
We have a tenant that gave a 30 day notice but still has not removed all items from property. They are telling us to take whatever rent is overdue out of their deposit. We can't show the property for possible tenants because of the remaining items they have left behind. They are also saying that they are not responsible for broken screens/broken window/burn marks on floor, saying that it was like that when they moved in, which is not true.
John, here is a useful article highlighting the steps for eviction... http://www.ezlandlordforms.com/articles/eviction_process___a_step_by_step_guide_to_eviction_in_all_states/  Additionally, All landlords in New York may benefit from reading this booklet.  http://www.ezlandlordforms.com/documents/4454/new_york_how_to_prepare_for_a_landlord_tenant_trial/
