Tenant is in Jail. He receives a Five Day Pay or Quit Notice on his apartment door and in the mail. His girlfriend turns in the keys within the five days of the notice, but she is not listed on the lease. Can we except the apartment as vacant now or not?

Did she say "I am handing in the keys on behalf of (tenants name)?" If so, you can except the apartment as vacant.
