How to Evict a Squatter in CA

Tenants of 40 years moved out of a duplex and turned in keys to property manager and said their friend will be all moved out in 4 days. That was over 3 weeks ago. The tenants moved out because they did not want to sign a lease or any contract at all nor wanted to pay any rent increase.  The duplex is 3 bedroom 2 bath 2 gar garage with all untilies and trash and water included. Had paid $300.00 a month for 40 years.  We have been waiting for this guy to get out so the unit can be repaired, cleaned up and re-rented at market rates. The squatter just called and said he will not leave he will pay us the $300 a month and if we don't like it he will see us in court. The police department said because he stayed after the tenants moved he established residency and we have to evict him. Do I serve him with a 3 day notice? We do not and will not rent to him. Is there something such as a Notice to vacate? HELP PLEASE

Yes serve a  3 day  notice to leave as they do not even have a lease, and file it with the court with a service of notice. You will see them in court and you will win. Make sure you have any paper trail , emails etc. from the previous tenant and get them out of there. This is a business after all! If you need further help your local court will also be able to direct you in the proper steps and forms to file.
