Late Notice Fee

Our lease states that our tenants need to give us 60 days notice prior to the end of their lease. We ended up finding out by mistake that they were planning on moving out a little over a month before the end of the lease. They had told us several times since January that they would be renewing their lease but never signed anything. Am I able to charge them a late notice fee from their deposit?

What is the late notice for? is it a fee that they did not give you enough time? If that is the case you can take a prorated amount from the deposit or request them pay it for the half of month that they were there. If they did not stay longer that their original end date time then you may just have to accept you loss and get a new tenant in as soon as possible. The best way to handle this would be to speak with the tenant and come to an agreed terms.
