I gave my tenant Three Day Notice To Pay Or Quit but he did not want to pay. He agreed to move out so do the landlord needs to file unlawful detainer to evict him if he already agreed to leave the property.

If he agreed to move out just set a final date for him to move out by and have him sign, if they do not move out by that exact date submit this to the courts and file the detainer at that point.
