Tenant surrendered keys

I have three year lease and tenant didn’t pay the full deposit then he didn’t pay rent we got together and he returned the keys does that mean he legally gave up the property? Can I rent property to to new tenants? This is a comercial property in California

Why did they have the keys in the first place? No full deposit and no rent.. I would check your lease and see what it says about non payment. I would also send a notice to vacate or something similar by certified mail. Post a notice for eviction since they never paid and document everything.
