is it legal to change the late fee after the tenant has signed the lease. What if a tenant tells you they are not signing anything, what do you do?

You can typically modify a month to month lease, but not a fixed term lease (ex: 1 year lease). If you are entitled to change the lease and you send them an addendum (ex: raising the price or changing late fee costs/process) and they don't sign, that is in affect a notice of non-renewal and means they should be leaving the premises. They can't just not sign a new form and not have to have any changes (again, if they are not locked into a time period lease).
