hi, my question is...I have 2 potential tenants. One gave the deposit to hold the apartment but did not sign a lease and the other has not looked at the apartment but is 90% sure she wants it. Can I cut the girl that put the deposit on it loose and rent to the other girl?

You can take whoever is more prepared to be a good tenant, if one has passed all tenant screening requirements and is ready then you can choose that person, no contract is in place yet so you are not held to anything but you will want to return the deposit to the person who has put it in.
