Serving Notices

Our rental properties is under my husband sole proprietorship business; can I still serve notices to the tenants as his agent?  We have never specified myself as his agent before but lately he has been busy with his truck driving job and is not able to attend to these things.  Thanks

Sometimes a lease will have wording  'you(landlord) or your agent' or something to that effect.
Hello,  Sorry to say but you may need the advice of a lawyer for this. In WI/IL where I rent, I had to get a "Limited Power of Attorney" relating to all rental properties for in order for a family member to act in my interest prior to my military deployment overseas.   If you don't want to go that route, you can always say your acting on your husband's behalf, but if a tenant pushes back, the court may not recognize your authority.  Matt
