Tenant claims family pet is visiting

How to handle a situation where a tenant claims a pet is visiting. We have a strict no pet policy. Can the tenant get around our pet policy by saying the pet is visiting? The pet is said to belong to a family member...however we have had a similar situation in the past with a different tenant with this same scenario and the damage to the property was significant. The pet was said to only be visiting. What are my (landlord) rights in this matter?

Not if it is stated in the lease that no pets are allowed or landlord must approve in advance, then the tenant is in violation of the lease. In lease violations, typically it's a 5 day correct or vacate. But understand, if the tenant refuses to vacate then by the time it gets to court the pet might be gone meaning the case would most likely be dismissed. Either way, 90 days before the lease expires (or 30 days if a MTM) issue the tenant a notice that the lease will not be renewed and they must vacate.
