who signs a lease when a trust is paying the rent?

Question: A female renter has a family trust that pays her rent. Who is legally bound to sign the lease? The occupant or the payee...i.e., the trust? or both?

Hi Brad, hmmm... legally I am not sure. However, you may want to have both sign the lease. Also make a note within the lease how the rent is being paid.

I'd have both sign the lease, that way they are jointly and severally liable to fulfill it. In other words that way you can go after the trust fund for damages and rent, and after the tenant, and after both.

If the people renting from you are the Trustees, they should sign it and add "Trustee" after their name.
