deposit

I m a new landlord . The previous owner transfer 995.00 to me during the purchase without walking throu sheets . One of my tenant left the other one stay a month to month. There is lot of damage in the appartment. The tenant who like to stay want a new lease and forfeit 995.00, in return i will not charge more than 995.00 of damage.. Any advice please! Is that legal?
