Tenant In 1 week-bank wouldn't cash initial check

Tenant gave post dated check and bank would not cash check. New tenants so have not occupied for 30 days yet...do I need to start a formal eviction or can I toss out based on 5 days to pay or vacate form?

If there was a contract signed you will need to give the proper notices for eviction, no matter how long they have been in there. If you give that notice then you can follow it up with the 5 day notice.
