Late fees during Covid

My tenants have moved out & left without doing a move out checklist & they still owe me late fees for June & July which they did not pay. They were late both days on paying the rent, I am doing their security deposit checklist & according to their lease they are charged $10 per day after the 3rd. Can I charge this during the Covid? I did not charge it for past months. Thanks!

Due to all the issues with Covid,, I would check online within your jurisdiction.
