ok so I had a tenant on month to month on July 22 he texted and said he would be out by the 1 of Aug.( that was my 30 day notice but in fact it was only 9 days) but he was not out until the 4 of Aug. I have rented the apartment on the 15th of Aug. Does he have to pay for the first 15 days of Aug.???

if he did not give sufficient notice, he is responsible for the months rent, even with the 30 days notice he is still responsible for those thirty days. Make sure to look up your government's website and look under landlord. :) Good luck!
