Massachusetts Landlords must provide all Tenants with this Notice of Occupants’ Legal Rights or post it in specific locations provided by the Massachusetts Code.

Notice of Occupants’ Legal Rights & Responsibilities

Title 105 of the Code of Massachusetts Regulations Section 410.400 requires that all property owners provide Tenants with a copy of the Notice of Legal Rights and Responsibilities.

Landlords can either provide Tenants with their own copy or post it adjacent to the mailboxes or in an interior location visible to all occupants. If it’s posted, it must be on durable material not less than 20 square inches in size.

We recommend that Landlords provide this Notice to all Tenants as an addendum to their Massachusetts Lease Agreement. This is an EZ way to ensure compliance with the regulation and to have documentation of compliance.
