New Jersey Lease Requirements: Flood Risk Disclosure



As of March 20, 2024, New Jersey Landlords must disclose flood risks to Tenants before entering into a Lease Agreement or renewing a Lease Agreement.

Under New Jersey law, Landlords must disclose if:


  • The rental unit is located in a FEMA Special Flood Hazard Area;
  • The rental unit is located in a FEMA Moderate Risk Flood Hazard Area; or
  • The Landlord has actual knowledge that the rental unit has previously flooded.

In addition, New Jersey Landlords should include specific language about Flood Insurance and the increasing risk of floods in New Jersey.
