As of January 1, 2026, California landlords must give tenants the right to opt out of third-party internet subscriptions and “bulk billing” deals, including internet, cellular, and satellite services. Use this form as an addendum to your California Lease Agreement to comply with this new CA lease law.



California Lease Requirements: Opt Out of Internet-Related Subscription Services


California Civil Code § 1942.8 gives residential tenants the right to opt out of third-party services offered with a tenancy.


For all tenancies beginning, renewing, or continuing month-to-month after January 1, 2026, tenants must be given the option of opting out of third-party subscriptions or bulk billing deals that provide internet, satellite, or cellular services.


Tenants who opt out will not be billed for services. If the tenant is billed, the tenant may deduct the billed amount from rent.


Landlords may not retaliate against tenants for opting out, nor may the landlord assess any penalties, hidden fees, or rent markups to tenants who opt out.


To ensure compliance with this new California landlord-tenant law, Landlords should attach this document to their California Lease Agreement.
