this section 8 tenant sent me partial rent dued after I sent him the 3-day notice. Can I start the court filing for eviction now or do I have to sent another 3-day notice with up-dated rent due amount? Or should I not cash the money order and just file with the court? Thanks for your help.

I believe it depends on what state you are in, and I also think because your tenant is sec 8 different rules apply. You may want to contact your local sec 8 housing dept in which you rental is registered. They will prob have the answer you need.
