Kentucky - security deposit

Tenant did not give 30 day notice......can we keep deposit since we have short notice to rent out?

If the tenant moves out without paying his last month's rent, and does not demand a return of the security deposit within thirty days, the landlord may use the deposit as payment for rent. However, if the tenant moves out having paid all rent due, the deposit must be refunded if no damages have been incurred.
