Tenant ability to trespass neighbor

Have an tenant renting one unit in a duplex in Ohio and another tenant renting the other unit

One tenant is not getting along with single family homeowner next door.

Tenant believes they can trespass neighbor for walking on property line/driveway of my property.

My thought is that only I could trespass someone on my property as the tenant is renting their unit and allowed to use the driveway.

Just trying to understand the trespass law here

I can provide some general information about trespass laws in Ohio, but please keep in mind that I am not a lawyer, and it's always best to consult with a legal professional for specific advice regarding your situation.

In Ohio, trespass generally refers to the act of unlawfully entering or remaining on someone else's property without permission. Trespass laws typically aim to protect the property owner's rights and privacy.

In the situation you described, the tenant may not have the authority to trespass the neighbor for simply walking on the property line or driveway of your property. As the property owner, you have the right to determine who can access your property and under what conditions. However, it's important to review the terms of the lease agreement to see if there are any specific provisions regarding use of common areas or shared driveways.

If the tenant is having disputes with the neighbor, it's generally advisable to encourage open communication and attempt to find a resolution without resorting to legal action. If the issue persists and becomes a significant problem, you may want to consult with an attorney who specializes in landlord-tenant or property law to discuss your options.

Laws can vary, and the specific circumstances of your situation may impact how trespass laws are applied. Consulting with a legal professional will provide you with the most accurate and relevant advice based on Ohio law.
