Tenant is not paying final two months

My tenant's lease is complete Oct. 31st.  She has not paid September or October or respective late fees.  Do I file a Dispossession suit? What are her angles...can she actually get away with this.  If I evict...can she get away with not paying?  For example, the lease is up anyway and what if she leaves the state? Do I have a case?

Michael---This sounds a bit tricky. What is in the lease about remedies? It may make the most sense to file a suit in small claims court to secure any rights you have.
