Lease Agreement not signed

Please help! A new tenant moved into my house and she has not signed the lease agreement. I live 8 hours away from the property and the person we hired to handle all this handed over the key when he got the security deposit and rent and did not collect the lease agreement. The tenant made a partial payment for the rent this month that bounced, and I still have no lease agreement! How can I get her out?

You may still go through the courts to evict with or without a lease. In most jurisdictions, if a written lease is not used but the intention to rent was present (collection of rent/security deposit, etc.)then you have what is called a verbal lease. So you should be able to go through the courts with a 3 day notice to pay rent or quit and start proceedings to evict.
