lanlord wont return security deposit

my previous lanlord said he would mail my deposit to our new address in another state, but has yet to do so. he will not return our phone calls or respond in any way. feb 1 will be 4 months since we moved. he did not do a walk through when we left, saying we were good tennants he wasn't worried about it. should i file a small claims case and return to ks? its the principle. thank you

If the landlord fails to return the security deposit or submit a statement to the tenant within the 30 days, the landlord forfeits all rights to the deposit. If the tenant does not give the landlord a forwarding address within one year of the termination of tenancy, then the tenant forfeits all rights to the deposit.
