60 Day Vacate - California

I have a tenant whom I sent a 60 day Vacate letter on Nov 6, 2009. The tenant is claming that they just receive my notice on Nov 27,2009. The vacate notice says they have to be out on Jan 7, 2009. Must i change this vacate date since they said they did not receive the notice until the 25th of November?

A 60 days' notice is required unless they have rented from you less than a yr. otherwise a 30 days' notice is required. If they have been with you over a yr sending a new notice will do you no good. If Jan 7th is an absolute for you, you may want to offer them an incentive to move out by that date. In the future, send all important notices by registered mail, return receipt.
