General Property Management
Please Define "Normal Wear & Tear"

I have seen this numerous times in numerous places, including my state statutes(MO). However I have not seen the term defined. My specific problem is this; I have a rental house that has tiled bathroom flooring that has withstood better than 20 yrs of service. My tenant constantly uses the tub as a baby sitter and doesnt mind her kids soaking the floor with water. Recently I noticed the tiles starting to lift and break, and the flooring is showing water damage from constanly being soaked. Is this going to be construed as Normal Wear & Tear since its a bathroom?

If push comes to shove, trying to convince a judge that a tenant is responsible for damage done by a wet child to a floor tiled over 20 years ago might be a tough sell.
