Tenant moved new person in without notice.

I have a 5 unit apts. and the only problem we have had is this 1unit. It started off as 2 girls and a son.one moved and then they let someone else move in thats not on the lease.I told her if she was to move in she would have to fill out an application.if she doesnt pass background check can i just give them notice to move? I would like them to move anyway.

You have to have positive proof because your tenant can say they are a guest. When you see there mail coming there or chlothes and furniture then you can react because they are not on the lease . Then you can send them a letter and state they are NOT on the lease and have to move. You have to react because if they stay a certain amount of time you have to evict them like your tenant .
