lease expired  can i evict tenants new york

my tenants lease expired i let them know 60 days in advance they said they would move but that was in october is febuary they still here and have not payed rent in 2 months can i just kick them out . they destroyed the apartment  have garbage in front and behind the house what can i do need help

You must go through the court system to evict. In most states, this means serving proper notice first, then wait the notice period out and if you hear nothing - generally you can file in court for a hearing. NEVER kick or lock out a tenant!
